Terms And Conditions
By purchasing ExceptionalGrad, LLC services, I agree to the terms of this Agreement:
1. Services:
ExceptionalGrad, LLC shall provide advice, consulting, and editing services to clients with respect to matters related to undergraduate, graduate school, law school, MBA, internship, pre-medical school advising/ medical school admissions/residency admissions/fellowship admissions and post-graduate programs. ExceptionalGrad, LLC will provide the specific services purchased by client (collectively, the “Services”).
2. Time and Availability:
ExceptionalGrad, LLC shall have discretion in selecting the dates and times it performs such consulting and editing services giving due regard to the client’s needs. If ExceptionalGrad, LLC client requires more services at any time, ExceptionalGrad, LLC is not obligated to undertake such work however it will always perform utmost diligence in providing requested services to clients.
3. Compensation:
Payment is due upon signing up for services. Fees are subject to change. Payment arrangements can be made upon discretion of ExceptionalGrad, LLC for applicants requiring financial assistance or graduated payment programs.
4. Confidentiality:
All communications between ExceptionalGrad, LLC and client are strictly confidential. All advice given to client is for his or her exclusive use only and shall not be shared with anyone else under any circumstances.
5. Exclusion from Services:
ExceptionalGrad, LLC’s provision of the Services of me is limited to the exact services purchased. ExceptionalGrad, LLC’s shall owe me no duty of ongoing consultation in this or other matters. ExceptionalGrad, LLC’s duties to me under this agreement will end when the retainer time has been used up and/or services completed. After that time, ExceptionalGrad, LLC’s consultation services with me pursuant to this Agreement will cease. Any future services are not a part of this engagement and will be covered by a separate agreement, when and if client pursues purchase of separate services.
6. Termination of Services:
Either of the parties involved, that being the client and ExceptionalGrad, LLC, can terminate this relationship at any time for any reason by giving written notice to the other party, including but not limited to services that are no longer required by the client, limited success of the working relationship between a client and advisor, or dissatisfaction with services of any kind upon client request. Upon termination by either party for any reason, I agree and acknowledge portion of fee’s paid will go as follows: for those services where an order was placed however no services whatsoever were rendered in any part, the client is eligible for a full refund or that of a full credit for future services. For order in which services were initiated, however completed less than half-way into said service of package, the client is eligible for a 50% refund or that of a 50% credit in price of the service purchased to be used for future services. In instances where greater than half of the package or service has been rendered and completed, the client is not eligible for refund or credit of any kind.
7. My Responsibilities:
I agree that I will cooperate with ExceptionalGrad, LLC in its delivery of the Services and will provide it with truthful responses to all questions that I am asked pursuant to this Agreement. I further agree to immediately notify ExceptionalGrad, LLC if anything occurs which changes the answers I have previously supplied or could impact the delivery of the Services.
8. Recording of Sessions:
I acknowledge that ExceptionalGrad, LLC has the right to record sessions as part of its Services and that I may listen to any such recordings with the express permission of ExceptionalGrad, LLC. I agree that I shall not distribute any such recordings of session or otherwise use same for any purpose, except as agreed to by ExceptionalGrad, LLC. I further agree that I shall not record any sessions under any circumstances, unless agree upon by both parties for clients future personal use only, never to be distributed commercially for any reason.
9. Further Agreements:
By purchasing ExceptionalGrad, LLC’s services I agree to the following: I release ExceptionalGrad, LLC, including its associated employees, consultants and contractors (all of whom shall be referred to as “ExceptionalGrad”) and discharge ExceptionalGrad, LLC from all claims, demands, or actions by me, on the basis of the discussions and interpretations of ExceptionalGrad, LLC. Consideration for this release and disclaimer of liability on behalf of ExceptionalGrad, LLC, shall be the services rendered by ExceptionalGrad, LLC. Each service requires full pre-payment, unless otherwise agreed upon. Fees paid to ExceptionalGrad, LLC are non-refundable, except as outlined in section 6 in termination of services agreements. ExceptionalGrad, LLC reserves the right to terminate a relationship with a client for any reason and at the sole discretion of ExceptionalGrad, LLC. If a refund is issued, this amount will be determined at the sole discretion of ExceptionalGrad, LLC at the time of termination. All services must be used within one year of purchase unless otherwise specified by ExceptionalGrad, LLC. Advice provided by ExceptionalGrad, LLC is the intellectual property of ExceptionalGrad, LLC. Services are not transferrable. All consultations must take place between the consultant and the client. Parents and significant others may participate in discussions with the express permission of the client. Guidance will not be offered directly to parents, significant others, or client sponsors. By purchasing ExceptionalGrad, LLC services, I agree with the aforementioned under any applicable law or regulation.
10. Cancellations:
for Consulting/Mock Interview/Brainstorming Sessions
Cancellation or changes for consulting sessions, brainstorming session and mock interview appointments must be made at least 24 hours prior to the scheduled appointment time otherwise client is charged in full.
11. Editing Services:
I acknowledge that I will submit a sufficient first draft of materials for editing of specified length (contact us for details). Personal statement rough drafts submitted for editing may be a maximum length as specified by ExceptionalGrad, LLC. ExceptionalGrad, LLC will not generate my materials for me. Editing services include revisions of the originally submitted documents only. New documents or essays cannot be substituted for subsequent revisions. If all revisions purchased are not used, no refunds or transfer or funds towards a different service will be issued. Documents edited by ExceptionalGrad, LLC cannot be published without permission in writing by ExceptionalGrad, LLC.
12. Submission of Application Materials:
ExceptionalGrad, LLC will not submit any application materials on my behalf nor will they log in to my web based application. ExceptionalGrad, LLC is permitted to use comments made by clients on the ExceptionalGrad, LLC website and in ExceptionalGrad, LLC materials as testimonials without my express permission as long as ExceptionalGrad, LLC posts those comments without my name or identifying information. None of the academic institutions or third parties referenced in ExceptionalGrad, LLC materials are associated directly in conjunction with the organization.
13. No Guarantee:
I acknowledge there is no guarantee, implied or otherwise, that the services provided by ExceptionalGrad, LLC will guarantee my chances of admission to undergraduate, graduate school, law school, MBA, internship, pre-medical school advising/ medical school admissions/residency admissions/fellowship admissions and post-graduate programs.
